Woman ‘didn’t agree to sex’

A Borders woman has told a jury how she woke to find a man raping her on a sofa.

She said she had not agreed to have sex with Mark Ormiston.

She told how he had returned to her home drunk following a day watching rugby matches in Jedburgh. She was relaxing in her pyjamas, watching music videos on television and had drunk a bottle of wine and some beers.

Ormiston – with whom she was having a relationship – appeared in a good mood, and they kissed and chatted about what they had each done that day.

The woman told the High Court in Livingston: “I kind of dozed off. I don’t think for very long. The next thing I remember was that Mark was on top of me. My pyjama bottoms were off.”

She added: “I was screaming and shouting at him, ‘Get off. Stop it, you’re hurting. It’s hurting.’ I was pushing at his arms, trying to push him off and kind of wriggling to get away.

“Eventually I did manage to get him off.”

She alleged that Ormiston then tried to force her to have oral sex.

When the alleged rape was over, she said she was “in shock” and went to bed alone, but woke the next morning to find Ormiston beside her.

Ormiston, 45, from Jedburgh, denies rape and breach of the peace, and has lodged a special defence that the woman consented to having sex with him.

The trial continues.
